1. Scope of application
The following general terms and conditions (hereinafter referred to as the T&Cs) apply to all sales of this online shop. The seller sells only to consumers in the online shop.
2. Prices, shipping charges, terms of payment
a) All prices in the online shop of the seller include the statutory value-added tax. The exception to this rule is the sending of physical products (CD) to third territory countries (meaning, countries outside the EU). Additional costs (e.g. customs duties and import sales tax) may be borne by the purchaser. The shipping charges are not included in the prices.
b) The shipping charges for physical products (CD) are $3 or the equivalent amount in Euro (about 2,95 €).
c) The prices are payable either by PayPal, credit card or Klarna (online banking, only in DE, AT, NL, BE, ES, IT).
3. Delivery and service time
Physical products (CD) will be shipped by the seller within 2 business days after receipt of payment.
For non-physical products (MP3, PDF), the buyer will receive a link to the download along with the order confirmation email. They can then immediately download their product.
4. Delivery of physical products, download of non-physical products
a) Worldwide shipping on physical products (CD).
b) The sale of non-physical products (MP3, PDF) via download is available worldwide.
5. Liability for Defects
The statutory claims by the buyer for defects are valid according to the provisions of the German Civil Code (BGB).
6. Reservation of title
The Seller reserves the title to the purchase item until all payments under the purchase contract have been received.
7. Information about storing the contract text
The contract text (details of the orders) is archived and stored within the shop system of the online shop www.music-of-my-soul.com. The contract text (details of the orders) can be viewed in the buyer profile of the personal account "My account" created by the buyer in the section "My orders".

After clicking on the "Add to Cart" button, the buyer can check their entries again by clicking the "Show Cart" button. If they now want to correct their input, they can change the quantity or delete the product from the shopping basket. After clicking the "Buy" button, the declaration of the buyer will be legally binding.

10. The individual technical steps for the conclusion of contract
The individual technical steps leading to a contract conclusion are described below. You will learn step by step how to buy a product as a customer in the online shop www.music-of-my-soul.com:
Step 1 - Product page: The buyer is looking at an article on the product page.
Step 2 - Product page: On the product page, the buyer clicks the "Add to Cart" button.
Step 3 - Product page: Clicking on the "Show shopping cart" button will take you to the shopping cart.
Step 4 - Shopping Cart: The contents of the shopping cart are displayed, the total cost of the order is calculated. A click on the "Buy" button leads to purchase processing.
Step 5 - Purchase processing: The buyer enters his customer data and selects a payment method. The links to the "General Terms and Conditions" and “Cancellation Policy“ open in a new window.
Step 6 - General Terms and Conditions: After the buyer has found out about the general terms and conditions, they close the window and have the purchase processing from step 5 in front of them.
Step 7 - Cancellation Policy: After the buyer has found out about the cancellation policy, they close the window and have the purchase processing from step 5 in front of them.
Step 8 - Purchase processing: The buyer confirms that they have read the general terms and conditions and the cancellation policy and agrees to their validity. A click on the "Buy" button executes the order.
Step 9 - Payment: The buyer pays via PayPal or direct bank transfer (SOFORT Überweisung, available in the following countries: Germany, Austria, Switzerland, Belgium, United Kingdom, Netherlands, Italy, Poland, Hungary, France, Spain, Czech Republic, Slovakia).
Step 10 - Order confirmation: The buyer receives an e-mail with the data of their order, including the general terms and conditions and the cancellation policy. If the buyer ordered a product as a download and their payment was received, they also receive the link to the download.
Step 11 - Shipping: After receipt of the payment, the physical goods will be shipped within 2 business days.
11. Newsletter
The buyer will be informed by mail about current offers or new CDs/sheet music at most 3 times a year.

12. Data Protection

c) The personal data of the buyer, as far as they are necessary for the justification, content development or modification of the contractual relationship (stock data), are used exclusively for the execution of the sales contracts concluded between the seller and the buyer, e.g. for the delivery of physical products (CD albums and ring binder sheet music) to the address given by the buyer.
d) The personal data of the buyer, which is necessary to enable the use of the offers of the Seller and to invoice (usage data), is also used exclusively for the execution of the sales contracts between the seller and the buyer. Such usage data is, in particular, the characteristics of the buyer's identification as a user, information on the beginning and end, as well as the extent of the respective use and information on the telemedia used by the buyer as a user. The seller will not use such data.
e) The buyer can request information at any time about their data stored by the seller.
f) The data collection and storage is carried out in accordance with § 28 BDSG.
g) The stored personal data will be deleted according to the legal regulations.
13. Online dispute resolution
Under the link http://ec.europa.eu/consumers/odr/ the EU Commission provides a platform for out-of-court disputes. This gives consumers the opportunity to resolve disputes related to their online ordering without the intervention of a court.
I am not participating in a dispute settlement procedure before an arbitration board and I am not obliged to do so.
14. Final clauses, applicable law
a) The contractual relations between the contracting parties are subject to German substantive law, with the exclusion of international private law and the UN purchase law.
b) If the buyer is a consumer, the place of fulfillment and the court of jurisdiction are determined by the legal provisions of the German Civil Code (BGB) and the Code of Civil Procedure (Zivilprozessordnung).
